This Agreement is entered into between the user ("You") and the provider of the current product regarding the use of the product. The "Current Product Provider" refers to Sangfor Technologies Co., Ltd. and other related companies associated with the provision of the current product, collectively referred to as "Sangfor" or "We" hereafter.
This Agreement is concluded between You and Sangfor. When You confirm and sign this Agreement by clicking/checking, the rights and obligations specified in the terms and conditions of this Agreement shall be borne by You. When You and Sangfor are separately referred to herein, each may be referred to as a "Party," and when referred to collectively, as "Both Parties."
Please read carefully and fully understand all the terms and conditions of this Agreement, especially those terms that exempt or limit Sangfor's liability, those that restrict Your rights, those concerning dispute resolution methods and jurisdiction, as well as targeted or specific agreements or other rules. Terms that limit liability, disclaim liability, or otherwise involve Your significant rights or interests will be highlighted in bold, underlined, or other forms to draw Your attention.
Unless You have fully read, completely understand, and accept all terms of this Agreement, please do not use the products provided by Sangfor. You click "Agree" or "Next" or similar buttons, check boxes, or You directly use Sangfor products, or You indicate acceptance of this Agreement by any express or implied means including downloading, installing, and using, or obtaining/login through accounts/account permissions, etc., all of which shall be deemed that You have read and agree to sign this Agreement, and this Agreement shall become a legally binding document binding on both Parties.
Article 1 Important Definitions
1.1 Product: "Product" under this Agreement is a generic term for various forms of solutions provided by Sangfor, including but not limited to software products, hardware products, subscription services, authorizations, other related services, or combinations of the aforementioned forms of products. The specific methods of use may include web pages, plug-ins, applications (possibly containing different versions), software development kits (SDKs) for use by third-party websites and applications, application programming interfaces (APIs), and other innovation forms emerging with technological development.
1.2 Authenticated User: Refers to a subject who has obtained the relevant product account/usage permission through registration or other methods permitted by Sangfor and uses product functions. Authenticated Users of the current product will be deemed to have full civil capacity and be independent natural persons.
1.3 Non-Authenticated User: Refers to a subject who has not registered an account and only browses product-related information or uses some product functions within a limited scope.
1.4 User: The Authenticated User and Non-Authenticated User under this Agreement are collectively referred to as "User," also referred to as "You."
1.5 User Data: Refers to data actively filled by Users during the registration of Sangfor product accounts and the use of Sangfor products, or data obtained/collected based on the agreement of this Agreement (including the User Data Processing Agreement) during the use of the products, as well as other related data generated from the aforementioned data. The types of User Data may include both network asset-related information and personal information.
1.6 Personal Information: Refers to all types of information recorded in electronic or other means relating to identified or identifiable natural persons, excluding information after anonymization processing.
Article 2 Product Use and Restrictions
2.1 Product Use Right License
2.1.1 License Statement: For the current product provided by Sangfor to the User, Sangfor and the terms and conditions of this Agreement grant the User a non-transferable, non-sublicensable, non-exclusive, limited, and revocable use license. Except as expressly granted, all other rights not expressly granted to the User under the terms and conditions of this Agreement are reserved by Sangfor, and Sangfor does not grant the User any implied license under this Agreement; When the User exercises these rights, additional written permission from Sangfor must be obtained, and if Sangfor fails to exercise any of the aforementioned rights, it does not constitute a waiver of such rights.
2.1.2 License Use and Maintenance: Users shall use the products on the premise of complying with the agreements of this Agreement and other relevant rules and restrictions. Unless otherwise agreed or stated, Users' use of the products under this Agreement is limited to non-commercial use. Users promise not to copy, duplicate, sell, resell, or use the current product or any part thereof for commercial purposes including but not limited to advertising and any other commercial purposes. For products that Users use through legally and validly authorized licenses, Sangfor shall provide product functions and related services to Users in accordance with the signed contracts, this Agreement, or other relevant rules, as well as Users' configuration or other forms of authorization/instructions, and provide comprehensive support and guarantees to the greatest extent possible during the User's use.
2.2 Product Use Specifications and Restrictions
Sangfor is responsible for complying with relevant laws and regulations applicable to the delivery of products to Users. However, since the current product outputs corresponding content to the User according to the User's instructions, the User's input instruction content and the purpose of the content output by the current product are independently determined by the User according to their own needs. Users shall assess by themselves whether it complies with the laws and regulations or policy requirements of the region where they are located in terms of network, information content, data, and other aspects involved in their own use needs and product function implementation.
2.2.1 Network Security Specifications
During the use of Sangfor products, You promise not to engage, or assist/instruct others to engage, in the following behaviors:
2.2.1.1 Disseminating software viruses or other computer codes, programs, or related information that may interfere with, destroy, or limit the functions of any computer software, hardware, or communication equipment by uploading, publicly posting, or targeted sending methods;
2.2.1.2 Illegally intruding, destroying, interfering, changing, or attempting to change the operation or connection of Sangfor's or any other third party's product functions, software, server systems, networks through technical means, or modifying, adding, deleting, stealing, intercepting, replacing data in server systems carrying product/service operation, or illegally occupying server space for product/service operation, or implementing other behaviors causing them to operate under overload;
2.2.1.3 Unauthorized mining/detection of possible vulnerabilities or defects in products or server systems through scanning or other methods, or violating relevant laws and regulations to publish vulnerabilities or defects, or using relevant vulnerabilities or defects to engage in behaviors that damage relevant products and Sangfor;
2.2.1.4 Producing, publishing, or disseminating software, media, or methods for the aforementioned purposes, regardless of whether such behaviors are for commercial purposes.
2.2.2 Information Content Specifications
During the use of Sangfor products, You promise to comply with the Constitution and laws of China, maintain public order, and respect social morality. You shall not produce, copy, publish, or disseminate information containing the following content, or intentionally provide technical support or any convenience/assistance for the production, copying, publishing, or dissemination of information containing the following content:
2.2.2.1 Opposing the basic principles determined by the Constitution, or endangering national security, national honor, and national interests, disclosing state secrets, inciting subversion of state power, overthrowing the socialist system, dividing the country, or destroying national unity;
2.2.2.2 Advocating terrorism or extremism, or advocating national hatred, national discrimination, destroying national unity, inciting regional discrimination or regional hatred, destroying national religious policies, or advocating cults and feudal superstition;
2.2.2.3 Fabricating or disseminating rumors about dangerous situations, epidemics, police situations, natural disasters, production safety, food and drug product safety, and other aspects that disrupt social order;
2.2.2.4 Disseminating incitement for illegal assemblies, associations, parades, demonstrations, or other behaviors that disrupt social management order and destroy social stability;
2.2.2.5 Fabricating or disseminating false information that disrupts economic order and social order and destroys social stability;
2.2.2.6 Disseminating obscene, pornographic, violent, gambling, homicide, or terrorist information, as well as instigating crimes, teaching criminal means and methods, manufacturing or trading prohibited articles, controlled articles, implementing fraud, and other illegal and criminal activities;
2.2.2.7 Endangering network security, or using the network to engage in behaviors that endanger national security, national honor, and national interests, or infringe upon the legitimate rights and interests of others;
2.2.2.8 Involving impersonation or false claims in the name of state institutions, social groups and their staff or other legal persons, or using others' names for the purpose of engaging in illegal or criminal activities;
2.2.2.9 Insulting or slandering others, infringing upon others' reputation, privacy, intellectual property rights, or other legitimate rights and interests, as well as endangering the physical and mental health of minors and being detrimental to the healthy growth of minors;
2.2.2.10 Distorting, uglifying, blaspheming, or denying heroic martyrs' deeds and spirit, or infringing upon heroic martyrs' names, portraits, reputations, and honors by means of insult, slander, or other methods;
2.2.2.11 Other content that violates laws and regulations, public policies, social security, public order and good morals, or infringes upon the legitimate rights and interests of Sangfor, other Users, or third parties.
Users shall be responsible for the legality of information content involved in publishing or disseminating through any means during the use of Sangfor products. For platforms/websites and other products independently operated and managed by Sangfor, Sangfor has the right to review information content involved in the process of Users using relevant functions/services. If Users violate the aforementioned information content specifications, Sangfor has the right to delete or block relevant content at any time without notice, and depending on the circumstances of the violation, impose restrictions on the use of functions on violating accounts, suspend, or even cancel them. All consequences and responsibilities arising therefrom shall be borne by Users themselves, and system logs or other relevant record data retained by Sangfor may serve as evidence of Users' violations of laws and regulations.
2.2.3 Other Behavioral Specifications
During the entire period of using relevant products, Users should avoid engaging in any behaviors that violate laws and regulations, the socialist system, national interests, citizens' legitimate interests, public order, social morality and information authenticity, as well as other illegal and criminal behaviors, and should not engage in any behaviors that infringe upon the legitimate rights and interests of other Users or third parties, interfere with Sangfor's normal operation or the stable operation of products/services, or other behaviors not expressly authorized by Sangfor, and Users promise not to provide any convenience or assistance to other third parties engaging in the aforementioned behaviors.
Article 3 Product Use Charges
3.1 Users shall pay product use-related charges in accordance with this Agreement and other relevant agreements signed to obtain valid authorization or license to use the current product. Users understand and agree: Sangfor has the right to independently decide, and adjust as needed, product functions or other related services that Users can use for free, as well as free use periods or other conditions to be met (Sangfor reserves the right to charge for any functions/services not expressly indicated in writing as free for Users), and will only provide corresponding technical support and guarantees within the scope prescribed by law or clearly stated by Sangfor.
3.2 Users understand and agree that the operation and maintenance of any product require certain costs. If Users make relevant requests to Sangfor beyond the scope of product functions or related services provided free of charge by Sangfor (including but not limited to accessing or exporting relevant usage data), in addition to confirming that such requests do not violate relevant laws, regulations, or requirements and do not infringe upon the legitimate rights and interests of other third parties, Sangfor has the right to independently evaluate the reasonableness of Users' requests, as well as the time limit or other necessary conditions required to respond to Users' requests, and has the right to require Users to bear reasonable costs required to meet their requests themselves.
3.3 Users should note that You shall pay Internet access fees, traffic charges, and other communication fees, information fees, etc. collected by third parties that may be incurred when using the product.
Article 4 User Statements and Guarantees
4.1 Legal Operation Guarantee
4.1.1 Both contracting parties guarantee that they have obtained legal operation qualifications or government approvals, etc., in accordance with relevant national regulations, and have the right to legally operate their respective products or services and other businesses. Both parties further guarantee that they will continue to maintain operation qualifications or approval procedures required by relevant national regulations during the validity period of this Agreement. Sangfor provides various products to You in accordance with the agreement or based on Your authorization, but will not participate in Your operation of related websites, applications, software, platforms, etc. Your websites, applications, software, platforms, etc., as well as the businesses and related content You engage in, shall be operated by You Yourself and You shall bear full responsibility.
4.1.2 If You choose to use products provided by Sangfor outside China, You shall evaluate by Yourself whether the product use meets Your cross-border use needs, including but not limited to compliance with requirements of local laws, regulations, policies, etc., especially permits or approval requirements related to cross-border data transmission, cross-border networking, etc.; at the same time, You shall also ensure that the business or non-business activities You engage in, relevant qualifications/licenses, as well as all behaviors related to the signing and performance of this Agreement, etc., all comply with the requirements of local laws, regulations, policies, etc., and shall bear full relevant responsibility.
4.2 Authorization Guarantee
If You are an authenticated User using relevant products based on the authorization/instructions/requirements of relevant enterprises or other entities, You shall guarantee that all relevant behaviors of Your use of the product have obtained legal, valid, and sufficient authorization from the enterprise or other entity, and will consciously fulfill all responsibilities in accordance with the agreements of this Agreement, as well as the system specifications, management needs, and true intentions of the enterprise or other entity, including but not limited to complying with account registration and use-related specifications, effectively conducting account security protection, standardized use of product functions, and paying attention to protecting the involved information systems and data security throughout the entire use process. Except as otherwise provided by law, Sangfor does not bear any responsibility to authenticated Users or any enterprises/other entities for authorization behaviors between authenticated Users and any enterprises or other entities, product use-related authority control, and relevant rights and interests disposal behaviors.
4.3 Third-Party Products/Services
4.3.1 If due to the specificity of the business You operate/manage, You need to use products based on third-party authorization or license as a prerequisite, You shall guarantee that You have met that prerequisite. Sangfor will accept Your entrustment to provide You with the products agreed upon in this Agreement or other related services based on Your aforementioned guarantee, and Sangfor does not bear any form of joint and several liability for Your behaviors that violate agreements with third parties or infringe upon the legitimate rights and interests of third parties.
4.3.2 You understand and acknowledge that the products provided by Sangfor and Sangfor themselves will maintain independence from third-party products or other businesses/contents. For issues legality, reliability, applicability, or quality of software/hardware, plug-ins, tools, or published advertisements, promotions, or publicity information (including commercial or non-commercial information) provided by third parties, You shall judge by Yourself and be responsible for Your judgment behavior; except as expressly provided by law, Sangfor bears no responsibility for any losses or damages You suffer due to products/services/information content provided by third parties.
4.3.3 This Agreement only applies to matters related to the use of the current product and does not apply to any other products provided by third parties through Sangfor products. Before choosing to use third-party products, You should fully understand and confirm by Yourself whether You accept the agreements or rules applicable to third-party products.
Article 5 Sangfor's Obligation Performance
5.1 Providing Products and Related Services
Sangfor shall provide products and after-sales services to You in accordance with the agreements of this Agreement. Meanwhile, in order to provide Users with perfect and high-quality products, Sangfor will periodically or irregularly conduct inspection, maintenance, upgrades, and optimizations on the products themselves or relevant infrastructure/equipment, systems, software, etc. that carry the operation of products (collectively referred to as "Routine Maintenance"). To ensure product safety and stability, Sangfor may also conduct major adjustments such as computer room/data migration, equipment replacement, etc. Routine maintenance and major adjustments may cause interruption or suspension of product use within a reasonable time. Sangfor will notify Users in advance, and Users shall cooperate. If non-routine maintenance is required due to force majeure factors, basic carrier faults, or other reasons, Sangfor will notify Users as soon as possible. Sangfor does not need to bear liability for breach of contract or compensation for damages for such interruption or suspension of services to Users.
5.2 Handling of Violation Behaviors
Users agree and accept that Sangfor has the right to conduct continuous supervision and review on the situation of their use of relevant product functions and other services. If Sangfor discovers that You have engaged in any behavior violated relevant agreements of this Agreement, or receives questions or complaints from third-party institutions or individuals regarding Your engagement in illegal or infringing behaviors, Sangfor will have the right to verify relevant behaviors or information content, and take corresponding handling measures according to specific circumstances, including but not limited to immediately suspending/terminating the use of relevant functions/services, deleting relevant information, and reporting to relevant departments, and has the right to require You to submit relevant explanations or proof materials within a specified limit as necessary, and You agree to cooperate in this regard. Sangfor does not bear any legal responsibility for losses caused to You due to Sangfor taking corresponding measures in the aforementioned circumstances. At the same time, Sangfor will reserve the right to pursue Your legal responsibility and claim all losses suffered by Sangfor from You (including but not limited to investigation fees, litigation/arbitration fees, attorney fees incurred due to rights protection, as well as business losses or claims suffered as a result).
5.3 Prevention of Illegal and Criminal Behaviors
Meanwhile, You should understand that if the Sangfor product You use is utilized through any means to engage in illegal and criminal behaviors such as fraud (including but not limited to sending fraud information, connecting to remote control to engage in fraud-related operations, etc.), gambling, prostitution, illegal lending, etc., when such events occur, Sangfor will make every effort to cooperate with public security or other regulatory agencies in investigation and evidence collection, and take measures conducive to reducing losses as much as possible. However, as a product provider, Sangfor cannot predict or control the occurrence of such events. Therefore, Users should always exercise caution during the use of products and related services to prevent corresponding risks brought by using products to engage in illegal and criminal behaviors.
Article 6 Confidentiality
6.1 Definition
Confidential Information refers to all technical and non-technical information (including but not limited to relevant materials such as product or service prices or marketing plans, business planning and strategies, customer lists and customer information, financial information, product development status or relevant technical solutions, etc.) disclosed by one party to the other party but not known to the public, capable of bringing economic benefits or other benefits to the disclosing party, and having practicality.
6.2 Confidentiality Obligation
6.2.1 Either party to this Agreement agrees to keep the aforementioned Confidential Information of the other party disclosed to it confidential and strictly restrict personnel who access the aforementioned Confidential Information to comply with the confidentiality obligations of this Article. Unless required by state organs in accordance with law or the aforementioned Confidential Information has entered the public domain, the party receiving the Confidential Information shall not disclose it to the outside.
6.2.2 Both parties to this Agreement expressly recognize that business data and other information owned by each party are important assets of each party and key Confidential Information, and agree to make maximum efforts to protect the aforementioned Confidential Information from being disclosed. Once discovering any risk or hidden danger or event of relevant Confidential Information leakage, both parties shall cooperate to take all reasonable measures to avoid or mitigate damaging consequences.
6.3 Validity Period of Confidentiality Obligation
During the product use period, both parties bear confidentiality obligations, unless otherwise agreed by both parties.
Article 7 Data Compliance and Privacy Protection
7.1 Specific circumstances of data involved in the use of the current product by Users, including but not limited to data types, processing purposes and methods, as well as data security protection, etc., will be centrally explained to Users through Annex I "Privacy Protection Policy" of this Agreement.
7.2 As a product provider, in addition to providing products that meet Users' needs, Sangfor will also be committed to working with Users through product function implementation methods and relevant interaction design to better implement data security and personal information protection, thereby better protecting the legitimate rights and interests of Users and relevant personal subjects.
Article 8 Intellectual Property Rights
8.1 As the owner of relevant intellectual property rights included in products provided to You, Sangfor legally enjoys intellectual property rights such as copyright, trademark rights, patent rights, etc. as well as legal protection of trade secrets. Intellectual property rights are valuable intangible assets on which Sangfor's business depends for existence, contained both in Sangfor products used by Users and in the brand image that Users recognize in Sangfor trademarks and logos. Sangfor promises to Users: products that Users acquire through legally authorized means and use within China are all independently and completely owned by Sangfor in terms of intellectual property rights, without any rights defects infringing upon third-party intellectual property rights.
8.2 Meanwhile, You understand and agree: during the process of using Sangfor's products, You shall not infringe upon intellectual property rights and other legitimate rights and interests owned by Sangfor in any way, including but not limited to not, without Sangfor's written consent, independently or allowing any third party to implement, license, or transfer the aforementioned intellectual property rights involved for commercial or non-commercial purposes, not copying, modifying, disassembling, decompiling, reverse cracking, reverse engineering, etc. on software and hardware products provided by Sangfor for Your use or any part thereof, or attempting to access or intercept any source code in Sangfor products through any means, not avoiding or destroying technical measures taken by Sangfor to protect intellectual property rights, and not modifying, destroying, or concealing trademarks or logos marked on Sangfor products or relevant system platforms without authorization. Sangfor reserves the right to pursue legal responsibility for any infringing intellectual property behaviors.
Article 9 Limitation of Liability
9.1 Disclaimer
You understand and agree that the products provided to You by Sangfor are provided in the status that can be achieved based on existing technology and conditions. Sangfor will make every effort to provide You with high-quality products, but due to limitations of industry technical level or other objective factors, Sangfor cannot guarantee that the products provided are completely flawless or fully applicable to Your business needs. Therefore, except for matters where Sangfor makes express guarantees to You in specific scenarios, Sangfor makes no commitment or guarantee regarding the validity, completeness, accuracy, reliability, timeliness, etc. of technology or information involved in the products provided, and does not need to bear any responsibility. If during the process of Users using the product, technical or other issues beyond the scope of commitments or cognition of both parties occur, both parties may seek joint resolution through friendly collaboration.
9.2 Force Majeure and Other Exemption Situations
You understand and agree that during the use of the product, the following situations may be encountered that cause interruption of functions/services. When the following situations occur, Sangfor will timely cooperate with relevant units to carry out repairs, but Sangfor will be unable to bear the losses suffered by You due to this:
9.2.1 Affected by force majeure factors, including but not limited to natural disasters, government actions, issuance and adjustment of laws and regulations, strikes (except internal labor disputes of either party), turmoil, etc. objective situations that cannot be foreseen, avoided, or overcome;
9.2.2 Affected by basic carrier services, including but not limited to technical adjustments by the telecommunications department, destruction of telecommunications/power lines by others, installation, transformation, maintenance, etc. of telecommunications networks/power resources by the telecommunications/power department;
9.2.3 Network security incidents occur, such as computer viruses, Trojan horses or other malicious programs, hacker attacks, etc.;
9.2.4 You use relevant product functions or services through means not permitted by Sangfor, or due to Your improper operation, account loss or theft, or faults in Your computer software, system, hardware, and communication lines, resulting in inability to use functions or services normally;
9.2.5 Other situations that are not the fault of Sangfor, and that Sangfor cannot control or reasonably foresee.
9.3 Liability Exclusions
Under any circumstances, Sangfor shall not bear any responsibility for indirect, punitive, sudden/accidental, or special damage consequences. The types of the aforementioned damage consequences include but are not limited to loss of profits, loss of interest, business interruption, destruction or loss of data or other assets.
9.4 Limitation of Liability
The total amount of liability for breach of contract or compensation for loss that Sangfor shall bear based on the products provided to You for violating applicable agreement terms or other relevant rules shall not exceed the total amount of fees charged for providing corresponding products.
Article 10 Agreement Term, Suspension and Termination
10.1 This Agreement is valid before termination or upon expiration of the current product use term (if applicable). Users understand and agree that when the conditions for suspension or termination of the use of all or part of the product functions agreed upon by Sangfor with Users through the terms of this Agreement or other means are achieved, Sangfor has the right to send a unilateral notice to suspend or terminate the provision to Users of the use license for part or all of the product functions agreed upon in this Agreement:
The suspension conditions referred to in this Article include but are not limited to: due to Users refusing to agree to updates to this Agreement or other relevant rules, or Users failing to renew fees in a timely manner after expiration of the authorized license use period, or other reasons attributed to Users themselves such as Users failing to satisfy the necessary conditions for using products due to violations of various obligations agreed upon in this Agreement;
The termination conditions referred to in this Article include but are not limited to: due to Users failing to renew fees for more than a certain period, or Users failing to satisfy necessary conditions for using products due to violations of obligations agreed upon in this Agreement, or actual damage caused to Sangfor due to Users violating legal provisions.
10.2 Sangfor has the right to adjust or terminate part or all of the functions of relevant products at any time according to its own operational arrangements (including but not limited to offline, iteration, integration, etc. of relevant functions) without prior notice, and any changes to the products shall be bound by the agreement terms effective at that time. For relevant product changes that may affect Users' businesses, Sangfor will notify Users as much in advance as possible so that Users can make preparations such as data transfer backups or business adjustments, avoiding unnecessary costs or losses as much as possible. For scenarios where Sangfor has notified Users that it will stop operating the current service, after agreeing with Users to shut down the service account, Sangfor will delete or anonymize personal information collected during the process of providing services in accordance with legal and regulatory requirements.
Article 11 Applicable Law and Dispute Resolution Jurisdiction
The place where this Agreement is signed is the location of Sangfor. The formation, validity, performance, interpretation, and dispute resolution of the Agreement, etc., shall all be governed by the laws of the People's Republic of China (excluding conflict of law rules, for the purpose of this Agreement, not including Hong Kong, Macao, and Taiwan regions); if there are no relevant legal provisions, commercial practice conventions may be referenced as applicable. If any dispute or controversy arises between You and Sangfor, it shall first be resolved through friendly consultation; if consultation fails, You agree to submit the dispute or controversy to the jurisdiction of the People's Court at the place where this Agreement is signed.
Article 12 Supplementary Provisions
12.1 Relationship
Sangfor and Users are independent contracting parties, and this Agreement does not constitute legal relationships such as partnership, agency, or employment. Neither party or its affiliated companies is the agent of the other party and has no right to bind the other party's conduct.
12.2 Transfer of Rights and Obligations
Without Sangfor's prior written consent, You may not transfer or otherwise transfer this Agreement or any rights and obligations under this Agreement. Any transfer or transfer that violates this Article is invalid. You understand and agree that Sangfor has the right to transfer part or all of the rights and obligations of this Agreement to Sangfor's affiliated companies on the premise of notifying You in advance.
12.3 Completeness of Agreement
The body of this Agreement, annexes, cited policies and documents, as well as other policies, rules, declarations, notices, warnings, prompts, instructions (collectively referred to as "rules" in this Agreement) related to this Agreement, constitute the complete agreement reached between You and Us regarding the current product. All the aforementioned types of rules are inseparable components of this Agreement and have equal legal effectiveness as this Agreement.
12.4 No Waiver of Rights Declaration
If Sangfor waives the rights prescribed in this Agreement when You are negligent or in breach of contract, it shall not be deemed that it waives rights regarding Your other or future similar negligence or breach of contract behaviors.
12.5 Severability
If any part of the content of this Agreement is invalid or unenforceable for any reason, it shall not affect the legal effectiveness of the remaining parts.
12.6 Agreement Updates
Based on the real-time, complex, and efficient characteristics of the Internet, as well as adjustments to legal/regulatory/monitoring requirements/policies, significant changes in Users'/Sangfor's businesses or operations, product function iteration updates, etc., You agree that Sangfor may update the body, annexes, or relevant rules of this Agreement from time to time. The modified agreement or rules will be re-submitted to Users for confirmation through this product interface, or separately notified to You through the effective notification methods set forth in this Agreement. If You do not agree to relevant changes to the agreement, You shall immediately stop using relevant products; if You continue to use, it indicates that You have fully read, understood, and agreed to accept the revised and updated agreement.
12.7 Notice
12.7.1 Authenticity and Validity of Contact Information
You shall guarantee and maintain the authenticity and validity of relevant materials submitted during the use of relevant products (including but not limited to phone numbers, email addresses, and other contact information). If the relevant materials submitted by You have any defects such as falsity or invalidity that may result in Your inability to timely learn business notifications, function/service prompts, technical support, dispute coordination, violation punishment, etc., information, the corresponding responsibility shall be borne by You Yourself.
12.7.2 Effective Notice Methods
You shall send notices to Sangfor according to the contact methods specified in this Agreement or published on Sangfor's official website, unless otherwise agreed by both parties.
Sangfor may send You various information related to products/services (including but not limited to updated user agreements, relevant rules, product/service upgrades, computer room removal, advertisements, etc.) through one or more of the following methods: webpage announcements, system notifications, in-site messages, emails, mobile text messages, instant messaging tools, letters, etc. The aforementioned information shall be deemed to have been delivered on the date it is sent or published (if the delivery date is a statutory holiday, the first working day after delivery shall be the delivery date).
12.7.3 Push Authorization
In order to better deliver required products to You or provide other related services supporting the use of products, for contact information such as phone numbers and email addresses that You actively provide when applying for or activating use (including trial) of products or specific functions, You agree that Sangfor may send You short messages or emails during Your use period to push real-time information on product use or product release/update information related thereto. Sangfor will provide You with unsubscribe methods, or You may also actively contact Sangfor's customer service personnel to solve relevant problems for You.
12.8 Export Control Compliance
Both parties promise to comply with the export control and sanctions laws and regulations of the People's Republic of China, and at the same time comply with other export control and sanctions laws and regulations applicable to this Contract. You promise not to use the products or services provided by Sangfor for military, nuclear weapons, fuel production or propulsion systems, missiles, rockets or unmanned aircraft systems, biochemical weapons, etc., and not to use the products or services provided by Sangfor for purposes prohibited by applicable export control and sanctions laws and regulations. Without permission from relevant competent authorities, You and other individuals or entities authorized by You to use Sangfor products or services will not provide controlled products, technology, software, or services to destinations, entities, or individuals prohibited by applicable export control and sanctions laws and regulations through Sangfor products or services.
12.9 Headings
The headings of all terms in this Agreement are only for content summary, for ease of reading, and the headings themselves cannot serve as the sole basis for interpreting the content of this Agreement's terms.
12.10 Language
This Agreement is written in Chinese, and any other language is for reference only. If there are conflicts between different language versions, the Chinese version shall prevail.
12.11 Conflict Application
If the provisions of this Agreement conflict with relevant agreements of the proprietary agreements or rules applicable to the specific product functions/services You use, the agreements of the proprietary agreements or rules shall prevail; if the provisions of this Agreement conflict with the terms of the procurement contract signed by You in specific projects with Sangfor or Sangfor-authorized distributors, the provisions of this Agreement shall prevail.
12.12 Contact Information
We value Users' feedback and suggestions, and also attach importance to the quality of content generated by artificial intelligence models. Therefore, if You discover that the content output by the current product or the processing results returned are unreasonable, have defects, or have other problems, You may send an email at any time to zgsm@sangfor.com.cn to provide feedback.

Annex II: Account Use Agreement
1. Account Registration
1.1 Any User using Sangfor products shall lawfully possess necessary and appropriate capacity for rights and capacity for conduct in accordance with the law, and shall complete registration or obtain the right to use relevant product accounts through other methods permitted by Sangfor in accordance with requirements such as real-name authentication, and shall consciously comply with relevant specifications and restrictions during account registration, including but not limited to not maliciously registering and using product accounts (malicious registration behaviors referred to in this article include but are not limited to frequent registration, batch registration of accounts, abuse of multiple accounts, buying and selling accounts, etc.).
1.2 Based on the positioning and functions of Sangfor's main business and products, we will primarily provide account registration and related functions/services to adult users. Before any entity instructs/authorizes a minor to register relevant product accounts or use products through any other means, it shall be responsible for obtaining consent from their guardian, and verifying the true identity of the authorized minor and their guardian through ID number, and shall pay attention to specially protecting the legitimate rights and interests such as personal information of that minor user throughout the entire use period.
2. User Information
2.1 Users shall fill in and submit authentic, legal, and effective information in accordance with requirements, including but not limited to user names, contact persons, email addresses, contact phone numbers, so that Sangfor may conduct real-name authentication on the identity of relevant subjects by itself or by entrusting a third party in accordance with relevant laws and regulations, or use it when necessary to verify the authenticity and legality of businesses carried out by relevant subjects using products or other related services provided by Sangfor. If any of the aforementioned information changes, You shall notify Sangfor in writing in a timely manner or update it Yourself according to the usage rules of specific products.
2.2 Users shall guarantee that information such as their registered account names, avatars, and profile descriptions (if any) will not contain any content that violates laws and regulations, public policies, social security, public order and good morals, or infringes upon the legitimate rights and interests of any third party, including but not limited to: not impersonating, falsely claiming, fabricating the names or logos of political parties, party, government and military organs, enterprises and institutions, people's groups and social organizations, countries (regions), international organizations, news media, as well as important geographical names, logos, etc.; not impersonating others (including but not limited to administrators) or unauthorized use of others' names, portraits or trademarks/logos; not intentionally containing QR codes, URLs, email addresses, contact information, etc.; and not containing content such as being untrue to the name, exaggerated, etc. that may mislead the public or cause misunderstanding.
3. Account Use Behavioral Specifications
3.1 During the period when Users log in to product accounts and use relevant functions/services, they shall consciously assume legal obligations related to the account entity, including but not limited to not utilizing any product functions through account login or other means to engage in behaviors that violate laws, regulations, or policy requirements, not interfering with Sangfor product operation or Sangfor's operational management of products through any technical means, not maliciously circumventing or resisting the rules of relevant functions/services, or breaking through account authorities or other use restrictions, not publishing or disseminating illegal or false information content or publishing advertisements through any means, not interfering with other Users' normal use of products through methods such as brushing posts, watering, fake rewards, etc., or infringing upon legitimate rights and interests of others through any other means.
4. Account Security Protection
4.1 Accounts will serve as the basis for identity recognition of Users' use of corresponding products. You shall take necessary and effective protection measures (including but not limited to conducting effective permission control, setting high-strength passwords and changing them regularly, etc.) for account names, passwords, and other information and account security.
4.2 If You discover that others are stealing Your accounts and passwords, or any other situations where Your account use permissions are obtained by others without Your legal authorization, You shall immediately notify Sangfor in effective ways and provide necessary materials (such as situation explanations, proving materials, specific requests and contact information, etc.). After Sangfor receives Your effective notice and verifies identity, confirms the fact situation, it will handle matters according to laws and regulations and agreement/rule agreements. Relevant responsibilities and consequences resulting from Sangfor's handling according to this Article shall be borne by You. If materials provided by You have flaws, resulting in Sangfor being unable to verify Your identity or unable to judge Your needs and thus failing to handle in time, resulting in You suffering losses, You shall bear them yourself. At the same time, You understand that Sangfor needs a reasonable period to handle Your requests. For losses You have already suffered before Sangfor takes measures, and for losses caused after Sangfor takes measures for reasons not attributable to Sangfor, Sangfor does not bear any responsibility.
5. Account Management
5.1 Besides account security protection, You should also establish and improve internal management systems and standardize the use and management of accounts. If any user actually violates this Agreement or other relevant rules or agreements, You have the obligation to immediately notify us, and at the same time should take appropriate actions to stop and correct relevant violation/breach behaviors, and be responsible for bearing all relevant responsibilities.
5.2 You understand and agree: As the operation party of products, Sangfor will have the right to take necessary measures including but not limited to limiting, suspending, or terminating access/use of corresponding products or other related services, in accordance with relevant laws or this Agreement and other relevant agreements, when any user exists in behaviors violating this Agreement or other relevant rules/agreements, or disputes related to account authority occur, in order to ensure the safe and effective operation of products to the greatest extent possible. If this results in users losing or clearing data related to their use of relevant products, Users shall be responsible for bearing them themselves; and Sangfor has the right to independently evaluate and establish a user account credit management system, and provide services or other relevant rights and interest guarantees to Users according to credit evaluation situations during the user account use period.
6. Account Authority Limitations and Termination
6.1 Account Cancellation
Generally, users with Sangfor product use accounts may independently operate to cancel accounts, or apply to Sangfor for account cancellation through contact methods in this Agreement body or other exclusive contact methods. Any account cancellation must meet the following conditions:
6.1.1 The account is in a normal state, not involving any dispute disputes (including complaints reports or being complained and reported), and not being subject to restriction measures by competent authorities;
6.1.2 There are no unfinished transactions within the account;
6.1.3 There are no outstanding rights and obligations within the account or situations where disputes may arise due to account cancellation;
6.1.4 There are no other situations that may affect account cancellation.
Sangfor will stop providing corresponding product functions and other related services to users whose accounts have been officially cancelled. After account cancellation, we will properly handle relevant data according to requirements of relevant laws and regulations and relevant agreements with You (if any).
6.2 To protect user account security, Sangfor has the right to independently detect and judge behaviors with abnormal access and take corresponding handling measures. For example, for accounts that have not logged in for a long time after registration or have no access or operation records for a long time after logging in, to protect user account security, Sangfor has the right to limit their login functions, and users need to reactivate accounts or log in again before they can use normally.
6.3 When Users violate relevant agreements of this Agreement or suspension or termination conditions of account use license authorities agreed upon between both Parties are achieved, Sangfor has the right to recover or terminate the use permission of the account used by You.
